MPD #578 – As Amended 1999
MPD # 578 was modified in 1999 by Alderman Richard Mell of the 33rd ward to prohibit Building material sales in "Subarea A"

This amendment effectively prohibits Home Depot on the Site.
Received full backing of the City Plan Commission and NORBIC in 1999.
Presented in Legal Documents by Rezmar in 2001 as the existing zoning for the site.

Officially retracted in non-public letter by Mell in December, 2001.

REZMAR'S FEB. 2001 Townhome Proposal

This proposal, made public in February of 2001, was for 164 townhomes and a park on the 10.5 acres. This was fully endorsed by Alderman Mell and community groups.

In May of 2001, Mayor Daley announced that he opposed re-zoning the site to be used for townhomes.

Mells December 2001 Retraction

In December of 2001, a full reversal of earlier zoning proposals as well as repeated pledges to the community that "Big Box" retail was dead for this site.
Mell states in 2001 that "circumstances have changed in my community and I now wish to permit the sale of building and home improvement supplies" on the site.

WHAT CHANGED???

MPD #578 - As Amended 2003

This amendment was introduced by Alderman Colom of the 35th ward on February 5th 2003.
This is a re-enactment of Alderman Mell's amendment to prohibit building material sales and other retail uses on the site. Essentially the same document, it was re-introduced after the ward re-mapping so that it is now filed under Alderman Colom's Name and the 35the Ward.
Due to extensive community pressure, both Alderman Mell and Alderman Colom pledged their support for the community in their objection to the Home Depot at a Town Hall Meeting on October 23rd 2002. IPNA as well as local business group KEBIC and local businesses Lee Lumber and Hi-Grade paint all expressed their opposition to the proposed Home Depot at that time. Alderman Mell pledged to re-introduce his ammendment prohibiting Home Depot, but the ward maps had changed and he was no longer alderman for the site. IPNA hired an attorney and drafted a revised version of the 1999 ordinance to Alderman Colom for her to introduce. This document is now pending in zoning committee, preventing Home Depot from getting zoning approval for their proposed store at Addison and Kimball.
